1. Eligibility

You must be at least 13 years old to use our services. By using Bandi Wala, you confirm that you have the legal capacity to enter into a binding agreement.

2. Service Description

Bandi Wala is a food ordering and delivery platform that connects customers with local street food vendors and home chefs. Orders can be placed through our website and mobile application.

While we manage and execute the delivery of orders, we do not prepare or cook the food ourselves. All food is prepared by independent vendors or home chefs listed on our platform.

3. User Accounts and Communication

You may need to provide personal details to use our services. You agree to receive updates and communications via SMS, WhatsApp, email, or in-app notifications.

4. Orders and Fulfillment

  • Once an order is placed, it cannot be canceled by the customer, unless the item is unavailable with the vendor.
  • Cancellations or modifications are allowed only if the vendor is unable to fulfill the order, in which case a refund will be processed.
  • Delivery timelines provided are estimates and may vary depending on vendor readiness, traffic, or unforeseen delays.
  • Bandi Wala ensures efficient and timely delivery, but we are not liable for delays caused by external factors beyond our control.

5. Payments

Payments are securely processed via third-party providers like Razorpay. We do not store your credit/debit card information. Final prices include applicable taxes and platform fees.

6. Refunds & Cancellations

  • Orders cannot be canceled once confirmed, and no refunds will be provided unless the item is unavailable with the vendor.
  • Refunds are only issued in the event of order unavailability with the vendor before preparation begins.
  • In cases of damage, spoilage, or misplacement, monetary refunds will not be provided. Instead, we will offer a replacement of the same item or another item of equal value, depending on availability.
  • If any payment processing issue is identified before the order is confirmed, the amount will be refunded to your original payment method.
  • Refunds, where applicable, are generally processed within 7 working days, but may take longer depending on payment gateway or bank policies.

7. Vendor Responsibilities

  • Vendors and home chefs are solely responsible for the preparation, hygiene, quality, and compliance with local food safety regulations.
  • Bandi Wala verifies vendors before onboarding by reviewing mandatory government-issued food safety licenses (e.g., FSSAI).
  • In addition to government regulations, Bandi Wala provides vendors with a set of internal hygiene guidelines and follows a self-defined hygiene protocol aimed at enhancing food safety standards.
  • Vendors are required to strictly follow these internal hygiene practices, and Bandi Wala frequently monitors vendor compliance through virtual checks, audits, and customer feedback systems.
  • While we set and monitor hygiene standards, the final responsibility of food preparation still lies with the vendors.

8. User Conduct

You are strictly prohibited from engaging in any of the following activities:

  • Misusing the platform for any illegal, fraudulent, or malicious purposes.
  • Harassing, threatening, or intimidating vendors, delivery agents, or any individual associated with Bandi Wala in any form.
  • Abusing the platform's discount or promotional systems for personal gain, including but not limited to fraud, exploitation, or deceitful practices.
  • Spreading false, defamatory, or malicious information about Bandi Wala, its vendors, or our services with the intent to damage reputation, credibility, or customer trust.

Failure to comply with these terms will result in immediate suspension or termination of your access to our platform, along with potential legal action.

9. Limitation of Liability

Bandi Wala acts strictly as an aggregator and delivery facilitator. Our role is limited to connecting customers with vendors and facilitating the delivery process. We do not engage in food preparation, quality control, or vendor operations. The vendors/home chefs listed on our platform are solely responsible for the preparation, hygiene, and quality of the food they offer.

Bandi Wala’s responsibility is limited to delivery: Our liability is strictly limited to the delivery process only. Once the food is successfully delivered to the customer, our responsibility ends. We are not responsible for:

  • Food-related health issues or allergies
  • Food quality or preparation errors
  • Vendor misconduct

Our liability is limited to the amount paid for the specific order in dispute. We are not liable for indirect or consequential damages.

10. Intellectual Property

All platform content, branding, and technology is owned by Bandi Wala or licensed. Unauthorized use is prohibited.

11. Privacy

Your use of the service is also governed by our Privacy Policy, which explains how your data is handled and protected.

12. Termination

Bandi Wala reserves the right to suspend or terminate your access to the platform and services immediately and without prior notice, if you:

  • Violate any of the Terms & Conditions
  • Engage in any fraudulent or illegal activities related to the platform
  • Attempt to manipulate or exploit the system for personal gain.
  • Misuse the platform for any purposes not intended by us, including using the platform for illegal activities, harassment, or any disruptive behaviors.

Upon termination, your access to Bandi Wala will be revoked, and you may be subject to legal action based on the severity of the violation.

Jurisdiction: This agreement shall be governed by the laws of India, with legal jurisdiction in the city of Hyderabad.
